1. Agreement

By using https://rootpurr.com(“the Site”) or buying our products, you agree to these terms. RootPurr, LLC (“we”, “us”) reserves the right to revise terms at any time; material changes will be posted with a new “last updated” date.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under US law to place orders. Wholesale and private-label buyers must purchase on behalf of a registered business entity.

3. Orders & pricing

• All retail prices are in USD and exclude sales tax, which is added at checkout where applicable.
• We reserve the right to refuse, cancel, or limit any order — in particular orders that appear fraudulent, incorrectly priced, or that violate these terms.
• For B2B orders, pricing is quoted per formula and volume. The quote is binding once both parties countersign the PO.

4. Shipping

Retail orders ship from our 3PL warehouse in central Pennsylvania, usually within 1 business day. Standard shipping in the contiguous US is free over $35 and $5.99 below. We do not currently ship retail outside the contiguous US. See the shipping policy for full detail.

5. Returns & refunds

Retail orders carry a 30-day money-back guarantee. The full canonical policy — including how to start a refund, eligible products, refund timing, and wholesale exclusions — lives at /shipping#refunds. If anything below ever conflicts with that page, the /shipping#refunds page controls.

6. Product safety

A sample of our cassava litter has been third-party lab-tested (formaldehyde, aflatoxin B1, and Salmonella all non-detect), and we publish that report on our Lab Testing page. Product is intended for use as cat litter. Not intended for human or other-species consumption.

7. Disclaimers & liability

The Site and product are provided “as is” without warranty beyond what's required by US law. To the extent permitted, our liability is limited to the amount you paid for the order in question. We disclaim consequential and incidental damages.

8. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules. Forum and venue for any dispute that is not subject to arbitration are addressed in Section 9 below.

9. Disputes; Binding Arbitration; Class-Action Waiver

Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court.

9.1 Binding individual arbitration.You and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any purchase from us will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, and not in court. The only exceptions are: (a) claims that qualify for small-claims court in a venue with jurisdiction over you, and (b) claims to enforce or protect intellectual-property rights (for example, trademark, copyright, or trade-secret claims), which either of us may bring in court.

9.2 Individual basis only; class-action waiver. Arbitration will be conducted on an individual basis only. You and we each waive any right to participate in a class action, class arbitration, consolidated action, private-attorney-general action, or any other representative proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

9.3 30-day opt-out. You may opt out of this arbitration agreement by emailing hello@rootpurr.com within 30 days of your first purchase, with the subject line “Arbitration Opt-Out” and including your full name and order reference number. Opting out will not affect any other provision of these Terms, and we will not retaliate against you for opting out.

9.4 Governing law and non-arbitrable venue. These Terms and any dispute between you and us are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. For any claim that proceeds in court under Section 9.1 or under Section 9.5 below, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Pennsylvania.

9.5 Severability. If any part of this Section 9 is held unenforceable, the remaining parts will continue in effect. However, if the class-action waiver in Section 9.2 is held unenforceable as to any claim, then this entire Section 9 is null and void as to that claim, and that claim will instead be resolved in the courts identified in Section 9.4. This is the standard Federal Arbitration Act carve-out.

9.6 Survival. This Section 9 survives any termination or expiration of these Terms or your relationship with us.
